Troubled Jackass star, Bam Margera, has received a huge boost of confidence as the lawsuit he filed over his firing from the upcoming Jackass 4 has been approved to move forward. The latest installment in the highly successful stupid-stunt franchise is due to arrive on February 4, 2022 after being delayed by the Covid-19 pandemic, but approval of Margera’s lawsuit could end up further delaying the film’s release. Margera has been a part of the franchise since it first began over twenty years ago and is considered one of its co-creators. Though the official creation of Jackass resulted after Johnny Knoxville became friends with Jeff Tremaine and began working for the long since defunct skateboarding magazine, Big Brother, Knoxville’s willingness to subject himself to painful yet hilarious stunts didn’t really take off until he had a crew alongside him. This crew included a host of willing performers and pro skaters, Jason “Wee Man” Acuna, and Margera. Initially, a TV series on MTV, Jackass, quickly outgrew the limitations of that medium and just two years and three seasons after it began, the series ended.

That same year after the TV series ended, the first Jackass film was released to much success. Two more theatrically released films followed over the course of eight years, with a major hiatus taking place until Jackass 4 was announced. However, as the new film kicked off its production, the inclusion of Bam Margera was contingent on the need for him to remain sober at all times. Margera’s troubles with alcohol and drugs has long been public knowledge, and it was only a matter of weeks before he was cut from the film due to his inability to stick to Paramount’s strict sobriety measures. As a result of his dismissal, Margera filed a lawsuit that contends he was unfairly fired from the production and put through “psychological torture” due to the regimen he was forced to follow.

Now, according to a new press release from Singer Associates, Margera has succeeded in the first round of his battle. A Los Angeles superior court judge has decided that his case has a “probability of success” to prevail, when the case continues early next year. The press release also states that the Los Angeles superior court judge contended that the defendants’ claim (in this case Paramount, MTV, Knoxville, Tremaine and others) against Margera’s ability to bring the suit and offer evidence was “baseless to the point of being frivolous.”

This, of course, is a sizable blow to the case against Margera, who continues to struggle with substance abuse issues. The case has previously been dismissed by other Jackass stars, including Steve-O, who called it “absurd”. While it’s still early days in terms of the entire lawsuit, it could have far-reaching effects on the Jackass franchise – even impacting the upcoming film’s release, creating even more delays for fans.

The case is certainly an interesting one, because it seems that the restrictions were initially put in place by Paramount and the rest of the Jackass cast to help Margera overcome the issues that have so far proven detrimental to his career. It’s also safe to say that the Jackass franchise will never be the same again after the court case is over and done with – regardless of who wins. That in itself is a huge loss for fans, who have spent years watching the friends prank and egg one another on into performing even dumber and more hilarious stunts.
