A photo taken on the set of the Batgirl movie suggests Lex Luthor is still in prison. Jesse Eisenberg made his DC Extended Universe debut as the LexCorp mogul in Zack Snyder’s Batman v Superman: Dawn of Justice in 2016. During the events of that film, the villain is arrested and put up in Arkham Asylum, only to escape during Justice League‘s post-credits scene and recruit Slade Wilson, a.k.a Deathstroke (Joe Manganiello) to form a league of their own.

Batgirl will be one of a few DCEU films taking the franchise a different direction post-Snyder. In the Heights star, Leslie Grace, has been cast as the titular heroine confirmed to be the Barbara Gordon iteration of the character. Brendan Fraser has also come aboard to portray the film’s pyromaniac villain, Firefly. Reprising their roles from previous DCEU films are Justice League‘s J.K. Simmons as Barbara’s father, Commissioner Gordon, and Micheal Keaton as Bruce Wayne/Batman, who will appear first in this year’s Flash movie.

Now that the Batgirl movie is in production, multiple photos have been surfacing online showcasing various looks at the set. One of them hails from the Batgirl Film News Twitter account and shows a magazine cover referencing Lex Luthor’s prison sentence for the Capitol Building bombing in Batman v Superman. The headline reads “BILLIONAIRE VILLAIN LEX LUTHER HIRES NEW LAWYER TO APPEAL SENTENCE,” which curiously misspells the villain’s name. Check out the set photo below:

This prop found on the Batgirl set raises the possibility that Luthor is still in prison during the events of the upcoming DCEU movie. If that is the case, it would effectively retcon Justice League‘s ending, which saw him escape. Another explanation for the magazine cover, which seems to be the more plausible one, is that Batgirl or parts of the movie are set before Justice League‘s ending. Some have also pointed to the headline “Luther Hires New Lawyer” as a possible reference to one of Gotham’s most famous attorneys, Harvey Dent.

This is one of a few Batgirl set photos to surface in recent days, another revealing a massive mural for Keaton’s Batman, which makes sense, since he is rumored to act as a mentor to the DCEU’s next generation of heroes. Whether or not this magazine cover is an indication that Eisenberg will return as Luthor in Batgirl remains to be seen, though it will likely just serve as an Easter egg for eagle-eyed fans.
